Terms of Service & Acceptable Use Policy

1. Acceptance of Terms

By purchasing, provisioning, accessing, or using any game server hosting, proxy container, or network infrastructure provided by NitroZen Cloud ("we", "us", "our"), you ("Client", "User", "Customer") expressly agree to be bound by these Terms of Service (TOS) and Acceptable Use Policy (AUP). If you do not agree to these terms, you must not purchase or use our services.

2. Network, Reverse Proxy & Tunneling Policy Strict Enforcement

NitroZen Cloud provisions edge-protected proxy containers (such as Velocity, BungeeCord, Waterfall, and Geyser) to serve as routing hubs for your Minecraft server network. To protect our network edge, IP reputation, and ensure high availability, the following strict network policies apply:

• Local Network Routing Only: Proxy instances hosted on NitroZen Cloud are provisioned strictly to route connections to backend game servers hosted within NitroZen Cloud's own infrastructure.
• Prohibition on External Tunneling / Shielding: Customers are strictly prohibited from configuring proxies to forward traffic or tunnel player connections to external third-party hosts or datacenters without prior written authorization from NitroZen Cloud management.
• Reflected Attacks & Abuse Liability: Any configuration that causes NitroZen Cloud IP addresses to forward bot traffic, reflect distributed denial-of-service (DDoS) traffic, or trigger abuse notices / blacklisting from external hosting providers or datacenters will result in immediate, non-refundable termination of the offending service.
• Outbound Network Restrictions: NitroZen Cloud reserves the right to firewall, null-route, or block unauthorized outbound game ports and connections from proxy containers to prevent involuntary participation in reflected attacks.

3. Acceptable Use Policy (AUP) & Prohibited Content

All containers and services must be used in accordance with applicable laws and fair use standards. The following activities are strictly forbidden on all NitroZen Cloud servers:

• Malicious Network Activities: Running Denial-of-Service (DoS/DDoS) tools, port scanners, IP booters, vulnerability scanners, or stressers.
• Cryptocurrency Mining: Any form of coin mining, proof-of-work computation, or background crypto software.
• Botting & Mass Crawlers: Running automated Web scrapers, spam bots, discord raid bots, or credential stuffing software.
• Piracy & Malicious Payloads: Hosting, distributing, or executing ransomware, malware, spyware, unauthorized keygens, or unlicensed commercial software.
• Resource Hoarding & Abuse: Intentionally overloading server CPUs or memory through fork bombs, infinite crash loops, or abusive Java threads designed to starve neighboring containers.

4. Port Allocations & Network Interface Management

Every server is assigned a primary port and, where applicable, authorized additional ports:

• Ports assigned through our control panel (e.g. game ports, Votifier, Simple Voice Chat UDP) are allocated specifically for the designated service.
• No Port Hoarding: Customers may not request additional ports without a legitimate, configured in-game plugin or service requirement.
• Binding Restrictions: Services must only bind to ports explicitly assigned to their container in the Pterodactyl panel. Attempting to bind to unallocated ports on the host node will fail and may trigger automated security alerts.
• We reserve the right to reclaim unused or dormant additional port allocations.

5. Billing, Payments & Renewals

We provide localized payment methods across Bangladesh including bKash, Nagad, Rocket, and Bank Transfer.

• Prepaid Services: All hosting services are billed on a prepaid basis (monthly, quarterly, or custom billing cycles).
• Renewal Invoices: Invoices are generated prior to your service expiration date. Customers must provide valid Transaction IDs (TrxID) upon sending payment.
• Suspension Grace Period: If an invoice remains unpaid after the due date, the server will be automatically suspended after a 24 to 48-hour grace period.
• Data Deletion / Termination: Suspended servers that remain unpaid for 5 days will be permanently purged from our nodes to free NVMe storage for active users. Purged data cannot be recovered.

6. Free Evaluation Trial & Refund Policy

We believe in total transparency, verifiable hardware, and zero-risk investments for our community:

• 24-Hour Free Evaluation Trial: Potential clients may request a complimentary 24-hour evaluation server via Discord ticket to benchmark CPU tick rates, BD-IX ping, panel controls, and SFTP transfer speeds before making any payment. Provisioning of evaluation servers is strictly dependent on node slot and hardware capacity availability to protect active paying instances.
• 24-Hour Money-Back Guarantee: Customers who order directly without requesting an evaluation trial beforehand are covered by our 24-Hour Money-Back Guarantee. If you are unsatisfied with server performance within 24 hours of provisioning, you will receive a 100% full refund via bKash, Rocket, or Bank Transfer.
• Trial Preclusion: If a customer previously evaluated the infrastructure through a 24-hour free trial server and confirmed satisfaction before ordering, the service is deemed tested and approved; the 24-hour money-back guarantee does not apply in such cases.
• Non-Refundable Circumstances: Refunds will not be issued after 24 hours from initial provisioning, nor for client-side configuration errors (e.g., corrupted world saves, broken plugins, misconfigured permissions, or incompatible modpacks).
• Zero Tolerance for Abuse: Services terminated or suspended for malicious activity, DDoS attacks, port scanning, or violations of our Acceptable Use Policy forfeit all rights to refunds.

7. Backups & Data Responsibility

While NitroZen Cloud utilizes Gen4 NVMe enterprise storage with RAID redundancy and provides 1-click snapshot tools in the control panel:

NitroZen Cloud shall not be held liable for any loss of game data, corrupt world regions, or inventory losses resulting from rogue plugins, server crashes, accidental deletion by server subusers, or failure to maintain independent backups.

8. Service Availability & DDoS Mitigation

NitroZen Cloud strives to maintain a 99.9% network availability standard. Scheduled maintenance windows, hardware upgrades, and emergency kernel security updates will be announced in advance via our official Discord community whenever possible.

Our automated multi-layer DDoS protection scrubs volumetric and protocol attacks in real-time. In the event of an unprecedented attack exceeding normal operational parameters, we reserve the right to temporarily null-route or filter targeted IP addresses to protect the stability of the entire hosting cluster.
